The PLN 10,000 KSeF relief delays issuing, not receiving

Use the direction of the invoice flow before you use the turnover threshold.

  1. Receiving started firstDomestic business invoices have been received through KSeF since 1 February 2026, even when the buyer can still issue outside the system.
  2. The threshold is directionalMonthly invoiced sales up to PLN 10,000 can delay mandatory KSeF issuing until 1 January 2027; they do not create a general opt-out.
  3. Offline24 is still KSeFThe invoice remains an FA(3) document and normally has to reach KSeF by the next business day.
  4. 2026 leniency is not repealThe temporary absence of monetary penalties for KSeF mistakes does not erase the underlying duties or the need for a tested workflow.

Poland’s smallest businesses can read the 2026 KSeF transition in two incompatible ways. One sentence says they may keep issuing paper or ordinary electronic invoices while their monthly invoiced sales stay at or below PLN 10,000. Another says receiving through KSeF became mandatory on 1 February. Both statements are true because they govern opposite directions of the same document flow.

The practical mistake is to ask only, “Am I exempt from KSeF?” The better question is, “Am I issuing this invoice, receiving it, or temporarily creating it offline before it enters KSeF?” That change of unit turns a vague exemption into an operational decision.

The PLN 10,000 relief delays one direction of the invoice flow

The official KSeF timetable does not give one start date to one business. It gives dates to actions. Large taxpayers crossed the issuing threshold on 1 February 2026. Most other businesses crossed it on 1 April. A taxpayer whose total monthly sales documented by invoices do not exceed PLN 10,000 gross can keep issuing outside KSeF through 31 December 2026.

Receiving follows a different clock. The Ministry of Finance states that receiving invoices through KSeF became mandatory from 1 February 2026, including for small businesses whose own issuing obligation began later. A large supplier can therefore place an invoice in KSeF without also emailing a PDF to a domestic buyer with a Polish NIP. The buyer needs access to the system or an integrated tool even while its outgoing invoices remain temporarily outside it.

Two-clock rule

One company can be outside the issuing mandate and inside the receiving mandate

IncomingReceive in KSeFActive from 1 February 2026
OutgoingIssue outside temporarilyOnly while the monthly invoiced-sales relief applies

The threshold attaches to the outgoing act of issuing. It does not disconnect the incoming KSeF mailbox.

Two KSeF clocks show receiving from 1 February 2026 and three separate issuing dates, including 1 January 2027 for monthly invoiced sales up to PLN 10,000
Read the left clock first. The small-business relief changes the issuing date on the right, not the receiving date on the left.

Receiving an invoice may happen before a PDF reaches the inbox

For a domestic VAT taxpayer, the date of receipt is generally the date KSeF assigns its identifying number. That rule changes familiar evidence. An email timestamp is no longer the primary event for an invoice delivered through the system, and a bookkeeping team cannot safely treat a shared mailbox as the complete purchase ledger.

The official guidance expressly answers the awkward transition case: a small business that cannot yet be required to issue in KSeF can still receive a large supplier’s invoice there from 1 February. Access may come through the free taxpayer applications, e-Mikrofirma or software integrated with KSeF 2.0. The operational control is therefore not “Can we create an XML?” but “Who checks incoming KSeF documents, how often, and how do they enter approval and payment?”

2026 direction test

Which date controls the action?

ReceiveDomestic business recipient with Polish NIP1 February 2026Monitor KSeF even if your own issuing mandate starts later
Issue2024 sales above PLN 200M gross1 February 2026Structured issuing already mandatory

IssueMonthly invoiced sales up to PLN 10,000 gross1 January 2027Temporary permission to issue paper or ordinary electronic invoices through 2026

Offline24 changes the upload clock, not the invoice data contract

Offline24 is not a permission to create an arbitrary PDF and decide later whether it belongs in KSeF. The invoice is still an electronic document compliant with the FA logical structure. Its issue date is the date placed by the taxpayer in field P_1. The normal deadline is to send it to KSeF no later than the next business day after issue so that the system can assign its number.

This creates a deliberate separation between issue and receipt. If a domestic business buyer receives the invoice through KSeF, its receipt date is the day the KSeF number is assigned. For recipients outside the standard domestic KSeF path, including consumers and certain foreign buyers, the actual delivery outside the system can control receipt instead. The recipient type is therefore part of the workflow, not an afterthought.

Offline24 worked example

A Monday invoice has two auditable moments

MONCreate FA(3)Set P_1 as the issue date
TUESend by the next business dayKSeF assigns the identifying number
RECEIPTUse the KSeF eventFor a domestic taxpayer, receipt follows number assignment

A planned maintenance window or declared failure can change the send deadline. It does not turn offline24 into an unstructured paper exception.

Four offline labels create four different obligations

The portal distinguishes ordinary offline24, announced system unavailability, an announced KSeF failure and a total failure announced through mass media. They are not synonyms. Offline24 is available without a system outage and normally uses the next-business-day rule. Announced unavailability or failure changes the legal trigger and the upload deadline. A total failure is exceptional enough that the invoice is not later sent to KSeF.

The visual copy also matters. Before an offline invoice is sent to KSeF, certain recipients receiving it outside the system need two verification codes labelled OFFLINE and CERTYFIKAT. The second code depends on a KSeF type-2 certificate. After the system assigns a KSeF number, the outside visualization uses one verification code with that number. A continuity plan that tests only XML generation but not certificate custody, QR rendering and later reconciliation is incomplete.

Continuity boundary

No 2026 monetary penalty does not mean no 2026 control

The tax administration says monetary sanctions for KSeF mistakes will not be imposed for 2026. That transition policy reduces immediate penalty risk; it does not replace invoice receipt, accounting evidence, payment approval, VAT timing or the need to correct a broken integration before 2027.

A small business needs an incoming owner before it needs a perfect API

A practical launch order starts with the direction that already applies. Assign a person or service to monitor incoming KSeF invoices. Record who can authenticate, who can grant rights, how an invoice enters approval, and what happens when the supplier’s data does not match the purchase. Only then map the outgoing threshold and decide whether the temporary PLN 10,000 relief is worth using.

If outgoing volume is low, continuing outside KSeF may save a short implementation sprint, but it also preserves two processes for a few months. A business should price the reconciliation cost against an earlier voluntary migration. The right choice depends on document volume, accounting software, outsourced bookkeeping and the ability to test offline certificates—not on the threshold alone.

This is the same distinction PolymathDesk has used when reading Poland’s shelter map as navigation rather than protection, the deposit-return network as access rather than throughput, and renewable acceleration areas as filters rather than permits. In each case, the public label names a system boundary, not the complete operational promise.

Questions about KSeF and the PLN 10,000 relief

Does the PLN 10,000 relief exempt a small business from KSeF entirely?

No. It temporarily allows qualifying businesses to issue paper or ordinary electronic invoices outside KSeF through the end of 2026. Receiving domestic business invoices through KSeF became mandatory from 1 February 2026.

When does a qualifying small business have to issue in KSeF?

The general date for the previously relieved group is 1 January 2027. The monthly condition and any other statutory exclusions still have to be checked against the business’s facts.

Can offline24 be used when KSeF is working?

Yes. The official guidance says offline24 has no outage prerequisite. It still requires an FA-compatible electronic invoice and normally requires sending it to KSeF by the next business day.

Does the absence of KSeF penalties in 2026 make compliance optional?

No. It is a transitional enforcement measure. The duties, invoice dates, receipt events and accounting consequences continue to exist, and sanctions can apply from 2027.
